Privacy Policy

Chara Investments, Inc. is doing business as Built Green Custom Homes. BGCH’s Privacy Policy is part of its Terms of Use document, incorporated therein by reference, and describes how BGCH handles user/visitor information collected and received from or through its websites, associated applications, including mobile apps, as well as other sources such as social media. This Privacy Policy does not govern the activities of, or applies to any third party.
Collection and the Use of Personal Identification Information
BGCH collects and uses personally identifying information that you provide in the course of seeking offerings or information from us. This personal identification information may include, among others, your name, address, phone number, e-mail address, contact information, and information about a property or properties you want to sell.
BGCH uses this information (and other information that we may collect from you as described in this Policy) for its business purposes, which includes contacting you, evaluating and valuing any property or properties that you are seeking to sell, and, creating and formulating transaction proposals for your consideration. BGCH may also contact you about any changes to its Terms of Use, this Policy and also provide property transaction specific information. BGCH may continuously monitor your compliance with its Terms of Use. BGCH, from time to time, may also provide you with offers based on the information collected from you as well as your location.
Sale to Third Parties of any Personal Information Collected About You

BGCH will not share your personally identifying information with any third party, except under the following circumstances: (1) information, as determined by BGCH in good faith, that is legally required to be revealed under any relevant statute, regulation, ordinance, rule, administrative or court order, decree, or subpoena; (2) information obtained or revealed during the course of BGCH’s enforcement actions pertaining to its policies and procedures, its Terms of Use, the terms of this Policy, the Online User Agreement, or any other agreement with it, or during the course of any disciplinary action(s); (3) information in a manner that is expressly allowed or permitted by the provisions of this Policy; (4) information as determined by BGCH in good faith that must be disclosed to remedy and correct what it believes to be false or misleading information, or to address such activities that BGCH believes to be manipulative, deceptive or otherwise in violation of law(s); and, (5) unless you are otherwise notified at the time of collection of data or information.
BGCH may share your personal information with third parties in connection with a merger, sale, acquisition, assignment, bankruptcy proceeding, reorganization or other disposition of some or all aspects of its business or assets.
“Nonpublic Personal Information” is the nonpublic information about you that has been obtained by BGCH from you. BGCH and its advertisers may collect Nonpublic Personal Information from the online forms completed by you; and, from information obtained as a result of your transactions with BGCH, our advertisers, or others, and from consumer reporting agencies. BGCH will not disclose any Nonpublic Personal Information except as permitted or required by law or as described herein. BGCH reserves the right to disclose all of the Nonpublic Personal Information that has been collected about you, as well as other information collected as described in this Policy, to its affiliates who offer related goods and services, as well as to nonaffiliated third parties that perform services on BGCH’s behalf, including marketing services, or other institutions with whom BGCH may have joint marketing agreements from time to time.
Other Information Provided or Posted by You

In addition to the practices described above, we may also use information we have collected from you to, at your election, provide you with information and advertisements about goods and services that BGCH believes may be of interest to you.
You may voluntarily or at request provide us with testimonials about your experience with BGCH (including a photo of yourself), along with feedback about BGCH’s services and your experience with BGCH. BGCH may use any such information you provide to enhance its services and for public-facing marketing purposes, such as through online or public display of your testimonial, feedback, and/or photo. You understand that the information and testimonials provided by you, not including your personal information, shall become the property of BGCH and it has the right to use that information in perpetuity without further consent and without any fee or royalty payable to you. BGCH may also incorporate the information you provide through messages, e-mails, or other means (though not your personally identifying information) into its materials or offerings and they shall too become the property of BGCH without any additional express consent as described above with the right of perpetual use without fee or royalty payable to you.
Access to BGCH Websites and Collection of Information

During your access to the BGCH’s Websites without you actively providing any personal information, BGCH collects limited technical information, such as your IP address and location. BGCH also uses cookies as described below. As a registered user, BGCH collects additional information about your use of the Websites including homes viewed, photos viewed, pages visited, information about your location and preferences for offerings. BGCH shall maintain your login credentials such as username and password.
Records of your use of BGCH’s Websites are the sole property of BGCH. BGCH reserves the right to use such information for its marketing, membership and any other business endeavors.
Cookies

BGCH, like most major websites on the Internet, uses cookies (text files placed on your hard drive by a web server) to assist in personalizing and maximizing your experience and time spent online on BGCH’s Websites. Cookies are not employed to run programs or deliver viruses to your computer. They consist of unique assignments to your computer and can only be read by a web server in the domain that was used to issue the cookie to you. The cookies are also used by BGCH to improve the Website experience of its users and visitors and to facilitate the optimum use of BGCH’s Websites by you.
Services that are Location-Based

In order to provide location-based services, it may be necessary for BGCH to collect, use, and share precise location data, including the real-time geographic location of your computer or device. Where available, location-based services are likely to use GPS, Bluetooth, and your IP (Internet Protocol) Address, along with crowd-sourced Wi-Fi hotspot and cell tower locations, as well as other technologies to determine the precise location of your device within the limits of the available technology. Unless you have provided consent, such location data is collected anonymously in a form that does not personally identify you, the user, and is employed to provide location-based services to visitors and users of BGCH’s Websites.
As an example, if your device shares its geographic location with a Service, that Service may select and display properties relative to the location of the device. Some location-based services may also require your personal information for the service to be provided successfully.

BGCH’s Websites may contain links to other third-party websites on the Internet. BGCH is not responsible for the privacy practices and policies of sites other than its own. BGCH encourages you to be aware of the privacy statements on other third-party websites and to read those statements carefully before proceeding to use such websites.
Protection of Website Information

Some areas of BGCH’s Websites are secured and can only be accessed using unique login credentials. As a user you must have a specific user identifier (user ID or username) and password to access resources through any password-protected portions of the Websites. Your login credentials and password are for your personal use only and strictly confidential and must not be shared as it could lead to your personal information being compromised. Further, you are responsible for maintaining the confidentiality and security of the login credentials, and are responsible for all activity occurring on the Websites on the basis of your login credentials and password. You are strictly prohibited from any sharing of your login credentials and/or password with any other person(s) and from any use of your login credentials other than for your use of the Websites in compliance with the Online User Agreement.
Third-Party Data Collection and Online Tracking

BGCH uses service providers such as Google Analytics (a service of Google, Inc. and Alphabet Inc.) to help analyze, understand and improve the usage of the Websites and the effectiveness of its marketing and outreach efforts. BGCH, Google Analytics, and/or BGCH’s other analytics providers may use cookies, your IP address or an anonymous identifier, as well as certain information from your browser, together with other non-personal information about your visitations to the Websites (including information like page views and visit times; app store views; app downloads; user engagement information like active devices and location; app crashes; and behavior metrics) and other websites, so that BGCH, Google Analytics, or third parties may improve the Websites and provide you with advertisements about goods and services of interest to you on the Websites and other websites (including through search engine results pages) and/or to provide BGCH analytical information about our Websites. If you would like to learn more about advertising networks, including choices about the use of information by Google Analytics and other companies for multi-site advertising purposes, please go to www.networkadvertising.org and www.networkadvertising.org/choices/. Additionally, Google offers a Google Analytics browser add-on (designed to be compatible only with certain browsers) to provide website visitors the ability to prevent their data from being collected and used by Google Analytics. This may also be referred to generally as Incognito mode and this designation may change from over time. This is a feature of some web browsers and you should contact the browser provider for more information.
Currently, various Internet browsers offer an option “do not track” or “DNT” option that uses a DNT header to indicate the DNT preference setting on the browser. BGCH does not track your activity over time and across different websites or online services other than as set forth herein, and we do not currently respond to browsers’ DNT signals with respect to the Websites.
Social Media; Third-Party Applications

The collection and use of information on social media websites and applications are governed solely by their own privacy policies and terms. Please remember that any information posted on or through the BGCH pages such as Facebook, Twitter, Google+, or on other social media pages or channels, is subject to the policies and practices of the applicable social media channel, and not BGCH’s.
BGCH may receive personal information from a social media site platform or application when you connect through a social media feed, post content, or otherwise interact with us using social media tools. As an illustration, BGCH may receive basic Facebook account information (name, email, gender, birthday, current city, and profile picture URL) through Facebook. Also, when you click “like” us, or send a “Tweet” to us through a social media channel, we may receive your username, handle, and any other available personal information from the social media site or application. All such information received from social media sites and applications is treated and used in the same manner and for the same purposes as described in this Policy with respect to similar information we obtain through the Site.
Privacy of Children

We are committed to complying with all applicable laws and regulations regarding the collection, storage, and use of personal information of minors under the age of 18, including the Children’s Online Privacy Protection Act of 1998. BGCH’s Websites are not directed at minors who are under eighteen years of age. BGCH’s Websites are business oriented and are designed to serve adult population in the United States of America who can legally enter into contracts. This automatically excludes minors as BGCH’s target audience.
We do not collect personal information from minors under the age of 18. Individuals under the age of 18 are not permitted to use the Websites without the supervision of a parent or legal guardian. We do not knowingly collect or solicit personal information from children under the age of 18 or knowingly allow such persons to register for an online account or to place orders or provide personal information through the Websites. If we learn that someone under the age of 18 has provided any personal information through the Websites, we will remove such users and permanently delete that information as soon as reasonably possible.
If you are a parent or guardian who believes that your minor under the age of 18 has submitted personal information or other information to us without your consent, please contact us using the contact page on BGCH’s Website. Once we have verified that you are the parent or the legal guardian, we will cooperate with you to discuss what, if any, personal information we have collected about your child and how that information may have been shared or used.
Changes to The Privacy Policy Statement

BGCH reserves the right to change this Privacy Policy at any time without advance warning. Notification of change(s) will be posted on the Websites after the change. Because these changes may affect your personal information, we suggest that you look for information regarding changes on a regular basis and review the changes as soon as they are published on the website. Your continued use of the Websites will be construed as acceptance of the changes to the Privacy Policy.
Disclosures for Compliance with the Law

Notwithstanding the provisions of this Privacy Policy or the Online User Agreement, information may be and will be disclosed to the concerned authorities as needed in order to comply with law, respond to facially valid process or subpoena, to stop or mitigate illegal activity or potential harm, to protect the security of information, and to protect against fraud conducted or intended to be conducted using BGCH’s electronic assets.
Maintenance of Information Collected

BGCH reserves the right to maintain the information that is collected indefinitely or it may be delete the information at any time in its sole discretion.
Security of the Websites

BGCH employs reasonable standard security methods to prevent unauthorized access, maintain data accuracy and privacy, and ensure the correct use of user information. BGCH maintains organizational, technical and administrative measures designed to protect your information against unauthorized access, loss, alteration or misuse. However, no data transmission over the Internet or any wireless network, whether encrypted ot not, can be guaranteed to be perfectly secure from a persistent hacker’s efforts. As a result, while BGCH tries to protect user information as much as reasonably possible, BGCH cannot ensure or guarantee the security of any information a user transmit to us, and you do so at your own risk. Should there be any breach of data, BGCH will make all reasonable efforts to inform the affected users as soon as possible and implement additional measures to combat recurrence of such events in the future.
Jurisdiction-specific Provisions and New Laws

We make best efforts for this Privacy Policy to comply with all legal requirements including the requirements of jurisdictions having unique laws regarding the collection and use of personal data (e.g., the California Consumer Privacy Act or “CCPA”). Should you be a resident of any such jurisdiction, this policy is hereby deemed to be amended as appropriate to comply with any such state or jurisdiction laws. Moreover, to the extent there is any conflict between this Privacy Policy and any and all privacy requirements under the law, including the CCPA and laws that may be enacted after this policy was created and updated, this Privacy Policy is to be deemed amended and updated to automatically conform with any and all such legal requirements.
How is Your Personal Information Kept Secure?

BGCH take reasonable steps and implements reasonable safeguards to protect your personal information from unauthorized access and its improper use.
If the CCPA applies to you, then you also have the following additional rights:
Deletion Rights: You have the right to request that BGCH delete any of your personal information that BGCH retains, subject to certain legal exceptions, such as U.S., state, local and non-U.S. laws, rules and regulations.
Disclosure and Access Rights: You have the right to request that BGCH disclose to you certain information regarding our collection and use of personal information specific to you over the last twelve (12) months. Such information includes:

  • The categories of personal information BGCH collects about you;
  • The categories of sources from which the personal information is collected;
  • BGCH’s business or commercial purpose for collecting such personal information;
  • The categories of third parties with whom we share the personal information;
  • The specific pieces of personal information BGCH has collected about you; and
  • Whether BGCH has disclosed your personal information to a third party, and, if yes, the categories of personal information that each recipient obtained.

No Discrimination: BGCH will not discriminate against you for exercising your rights under the CCPA, including denial of service, suggesting that you shall receive, or be charged, different rates for services or suggesting that you shall receive, or provides, a different level or quality of service.
How to Exercise Your Rights: To exercise any of your rights under the CCPA, or to access this notice in an alternative format, please submit a request on your behalf using any of the methods set forth in the Contact Us section below.
For any requests relating to the exercise of your rights under this Privacy Policy, including the CCPA, or questions regarding BGCH’s processing of your personal information, please submit or have your authorized representative submit a request using any of the methods set forth below.
BGCH will contact you to confirm receipt of your request, including under the CCPA and request any additional information necessary to verify your request. We verify requests by matching information provided in connection with your request to information contained in our records. Depending on the sensitivity of the request and the varying levels of risk in responding to such requests (for example, the risk of responding to fraudulent or malicious requests), BGCH may request further information or your investor portal access credentials, if applicable, in order to verify your request. You may designate an authorized agent to make a request under the CCPA on your behalf, provided that you provide a signed agreement verifying such authorized agent’s identity and authority to make requests on your behalf, and we may verify such authorized person’s identity using the procedures above.
BGCH will respond to a consumer request within forty-five (45) days of our receipt thereof. BGCH will notify you in writing if it cannot comply with the request and provide an explanation of the reasons.

BGCH strives to assure the correctness of the information it maintains.
